Abstract	The article deals with the violation of special rules as the main socially dangerous act as part of the crime envisaged in Art. 239 “Рollution or damage to land” of the Criminal Code of Ukraine. It is concluded that special rules are characterized by such essential features: their normative or individual character; the presence of a specific person in charge of the respective duties; special character of rules; the legal force of the special rules at the time of the violation; obligatory nature of the rules that are violated; special rules apply to the handling of substances, wastes or other materials that are harmful to life, human health or the environment.
